(CNN) — A suspect has been arrested in the slaying of a 19-year-old Puerto Rican man found Friday decapitated, dismembered and partially burned, police said Tuesday.

Members of the U.S. gay community are asking authorities to investigate whether the slaying was a hate crime because the victim, Jorge Steven Lopez Mercado, was gay, said Pedro Julio Serrano of the National Gay and Lesbian Task Force.

“The brutality of the slaying and the fact that he was openly gay leads us to believe it was very possibly a hate crime,” Serrano said.

Authorities are investigating whether the killing involved sex, Guayama police Commander Hector Agosto Rodriguez told CNN affiliate WLII TV.

Guayama prosecutor Jose Bermudez identified the suspect as John A. Martinez, 26. Police had earlier described him as a 27-year-old man from the interior Puerto Rican town of Cayey.

Martinez was scheduled to attend a court hearing Tuesday night at which charges would be lodged, said Luis Bernier, a spokesman for the Guayama police district, which has jurisdiction in the case. The hearing was postponed several times throughout the day. Officials were waiting for a prosecutor from a nearby district, causing the delay, Bernier said.

The FBI was not directly involved in the investigation Monday, said FBI Agent Harry Rodriguez of the San Juan office.

“The FBI is monitoring this investigation by police in Puerto Rico,” Rodriguez said. “Any assistance that the police requests or requires, we would be more than happy to provide.”

Puerto Rican authorities may ask for help with forensics or other advanced investigative tools the FBI could provide, Rodriguez said.

The U.S. attorney’s office, in consultation with local officials and other agencies, would determine if the slaying was a hate crime, which is a federal offense.

“It’s at a very preliminary stage,” said Lymarie Llovet, a spokeswoman for the U.S. attorney’s office in San Juan, Puerto Rico’s capital.

Puerto Rico is a U.S. territory, which means federal agencies have jurisdiction.

A GAY man who claims he was discriminated against in a small town has had his case thrown out because he was the kind of person who was always miffed at others.

The Administrative Decisions Tribunal found that the man had a personality that made him think his rights were constantly being violated, the Daily Telegraph reported.

The man, who can be identified only as MT, says he was repeatedly forced to leave his New South Wales town of 2500 because of harassment over his sexuality.

A 16-year-old Spaniard is set to undergo a surgery so that she can become female – that is, if she gets an ok from a Spanish judge. The teen’s parents have co-signed on their child’s operation, but Spanish law dictates that children under 18 who wish to undergo gender reassignment surgery must receive a judge’s approval, regardless of whether their parents are on board.

Dr. Ivan Mañero, head of the “gender disorders” unit of Barcelona Clinical Hospital, says the 16-year-old is an ideal candidate for gender reassignment surgery. Dr. Mañero, who was asked by the teen’s family to comment on the case on their behalf, likened the situation to denying a leukemia patient treatment until he or she turned 18. He argues that transgender teens deserve treatment for their very real medical problem now that they have viable solution to a treatable issue.

Adds Gina Serra of the Association of Transsexuals in Cataluña, “Kids as young as eight years old know what they are and what they are not, although their conviction depends on the level of support they receive from their families.”

If the judge in this case decides to approve the teen’s bid for gender reassignment surgery, it would be the first instance of a minor under the age of 18 undergoing such a procedure in Spain.

There exist, however, other cases where children under 18 have successfully undergone surgery. One famous(ish) examples is Kim Petras – a 16-year-old German pop star who was born Tim. Says Kim:

“I was asked if I feel like a woman now — but the truth is I have always felt like a woman — I just ended up in the wrong body.”

Then there was the case of a 17-year-old Argentine who went to court in order to get permission to undergo surgery because of laws “against mutilation.”

Maybe this case will be a baby step towards realizing that teenagers can be in charge of their gender identity and health.
